1. Introduction

Welcome to Facilitate Strategic Services (Pty) Ltd (“we,” “us,” or “our”). These Terms and Conditions govern your use of our website (www.facilitatestrategicservices.co.za) and your engagement with our services, including Strategic Facilitation, PPE Supply, HR Consulting, and Tender Administration.

By accessing our website or engaging our services, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access the website or use our services.

2. Services

We provide a range of business solutions, including but not limited to:

• Strategic Consulting: Facilitation of workshops, strategic planning, and business analysis.
• PPE & Safety Equipment: Supply and delivery of personal protective equipment and safety gear.
• HR Services: Recruitment, policy drafting, and labour relations advice.
• Tender Services: Administrative support for tender compilations and compliance.

We reserve the right to modify, suspend, or discontinue any service at our discretion without prior notice.

3. Quotes and Payments

• Quotations: All quotations provided are valid for a period of 7 days from the date of issue, unless otherwise specified, due to currency and stock fluctuations.
• Payment Terms: Payment terms will be stipulated on your specific invoice. Generally, for PPE orders, full payment may be required prior to delivery. For consulting services, a deposit may be required before work commences.
• Late Payments: We reserve the right to charge interest on overdue accounts at the maximum rate permitted by South African law.

4. Supply of Goods (PPE)

• Delivery: Delivery timelines provided are estimates. While we strive to meet deadlines, we are not liable for delays caused by third-party couriers or supply chain disruptions.
• Risk and Ownership: Risk passes to the client upon delivery of the goods. Ownership of goods remains with Facilitate Strategic Services until full payment has been received.
• Returns: Returns are handled in accordance with the Consumer Protection Act (CPA). Defective goods must be reported within 7 days of receipt. Goods returned for reasons other than defects may be subject to a handling fee.

5. Consulting & Professional Services

For HR, Tender, and Strategic Consulting services:

• Accuracy: We provide advice based on the information you provide. We are not liable for errors resulting from incomplete or inaccurate information supplied by the client.
• No Guarantee of Outcome: While we provide expert tender administrative support, we cannot guarantee the award of any tender or contract.

6. Intellectual Property

The content on this website, including text, graphics, logos (FSS), and images, is the property of Facilitate Strategic Services and is protected by South African and international copyright laws.

7. Limitation of Liability

To the fullest extent permitted by law, Facilitate Strategic Services shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of our services or website.

8. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Cape Town.
